New Zealand Bill of Rights Act 1990Advice provided by the Ministry of Justice and the Crown Law Office to the Attorney-General on the consistency of Bills with the Bill of Rights Act 1990The Ministry of Justice, and the Crown Law Office in the case of Bills developed by the Ministry of Justice, advise the Attorney-General on the consistency of all Bills with the Bill of Rights Act. Advice provided to the Attorney-General since 1 January 2003, on the consistency of individual Bills with the Bill of Rights Act, is displayed on this site. The Attorney-General retains legal professional privilege in respect of unpublished advice written before January 2003 on the consistency of Bills with the New Zealand Bill of Rights Act 1990. The advice is not subject to the Official Information Act 1982; however, the Attorney-General will consider requests for the release of such advice on a case by case basis. The advice provided to the Attorney-General since 1 January 2003 can be found by using this site’s search option or by viewing the display under the following three headings: If a Bill is considered inconsistent with the Bill of Rights Act, then the Attorney-General brings the inconsistency to the attention of the House of Representatives. The Attorney-General makes this report to the House (as required by section 7 of the Bill of Rights Act) on the introduction of a Government Bill, and as soon as practicable after introduction for all other Bills. These section 7 reports from 1 January 2003 are displayed on this site, and linked to the relevant advice and Bill. Section 7 reports from 1999 to 2002 are available on the website of the New Zealand Parliament. Use this search page to locate a report. On occasion the Ministry of Justice and the Crown Law Office may advise the Attorney-General on the consistency of a Supplementary Order Paper with the Bill of Rights Act. This advice is published on this site on a case by case basis. Therefore, only a selection of this advice is displayed on this site, linked to the relevant Bill and to the advice provided on that Bill. |
