Note: This is not a comprehensive list of all fees payable in New Zealand Courts and Tribunals.

PAYABLE UNDER THE SUPREME COURT FEES REGULATIONS 2003

PAYABLE UNDER THE HIGH COURT FEES REGULATIONS 2001

1 Filing (including sealing where necessary) the original document commencing any proceeding (other than an interlocutory proceeding) to which these regulations apply, unless otherwise provided for,—

 

 

  (a) in the case of a concession rate proceeding:

$400.00

  (b) in the case of any other proceeding:

$1,100.00

  For the purposes of this item, the original document commencing any proceeding is,—

 

  (c) in the case of a proceeding commenced by statement of claim, including  an application to put a company into liquidation, the statement of claim; and  
  (d) in the case of an appeal or cross-appeal, the notice of appeal or other document by which the appeal or cross-appeal is instituted; and  
  (e) in every other case (including a proceeding to which Part IV or Part IVA of the High Court Rules applies), the first document (other than a caveat or an application for directions as to service) filed in the proceeding by the plaintiff/creditor that gives to the Court and to the opposite party (if any) particulars of the claim made, or of the order or other relief sought, by the plaintiff/creditor (this includes a creditors application for adjudication).  
2 Filing an interlocutory application, (other than an application for summary judgment)-

This item applies, unless otherwise provided, in respect of the hearing of every proceeding, including—

(c) the hearing of every appeal and every cross-appeal; and

(d) the hearing of every interlocutory application (other than an interlocutory application for summary judgment in respect of which an affidavit in answer has been filed).

 

 

 

 

9 Hearing an interlocutory application for summary judgment in respect of which an affidavit in answer has been filed (fee for each half-day or part of a half-day after the first half-day):

PAYABLE UNDER REGULATION 3 OF THE PROPERTY LAW (MORTGAGEES' SALES) REGULATIONS 1983

1 Application for mortgagee sale (pursuant to section 103(1)(a) of the Property Law Act 1952):

2 Commission on sale of 0.25% (payable by the mortgagee pursuant to section 103(1)(b) of the Property Law Act 1952)

(From a minimum of $100 to a maximum of $5,000)

 

PAYABLE UNDER CLAUSE 2 OF THE ADMIRALTY (FEES) ORDER 1997

1 In respect of the filing of an application under rule 776 of the High Court Rules for the issue of a warrant of arrest:

2 In respect of the filing under rule 784 of the High Court Rules of a request for a commission for the appraisement and sale of any property: $900.00

PAYABLE UNDER REGULATION 2 OF THE RATING (FEES) REGULATIONS 1997

1 On the filing of an application to enforce a judgment for rates under section 67 of the Local Government (Rating) Act 2002:

$145.00

2 For the sale or lease of  a rating unit under section 70 of the Local Government (Rating) Act 2002: $535.00

PAYABLE UNDER THE SHERIFFS' FEES REGULATIONS 1988

1 For every warrant on writ of sale, writ of arrest, attachment, or other process, including the application, execution, and return:

$920.00

2 For advertising a sale: The amount actually paid.  
3 For conducting a sale by auction: The amount actually paid to an auctioneer by way of commission.  
4 For service of any summons beyond 1 kilometre from the Sheriff's office, a fee, at a rate to be determined by the Sheriff, for every kilometre one way:

Provided that the rate determined shall not exceed the maximum rate for the time being payable to an employee of the Public Service who uses the employee's own motorcar on official business.

 

PAYABLE UNDER THE DISTRICT COURTS FEES REGULATIONS 2001

1

Filing of the original document commencing any proceeding (other than an interlocutory proceeding) to which these regulations apply, unless otherwise provided for:

For the purposes of this item, the original document commencing any proceeding is,—

  1. in the case of a proceeding commenced by statement of claim, the statement of claim; and
  2. in the case of an appeal or cross-appeal, the notice of appeal or other document by which the appeal or cross-appeal is instituted; and
  3. in every other case, the first document (other than a caveat or an application for directions as to service) filed in the proceeding by the plaintiff that gives to the Court and to the opposite party (if any) particulars of the claim made or other relief sought by the plaintiff.

Hearing a claim, objection, application, or other proceedings filed under section 21 of the Land Valuation Proceedings Act 1948; for each such claim, objection, application, or other proceeding:

PAYABLE UNDER REGULATION 2 OF THE FAMILY PROCEEDINGS (COURT FEE) REGULATIONS 1998

 

For filing any of the following applications under the Family Proceedings Act 1980 in a District Court:

  1. An application under section 27 (for a declaration whether according to the law of New Zealand a marriage is valid or a marriage has been validly dissolved):
  2. An application under section 29 (for an order declaring a marriage to be void ab initio):
  3. An application under section 32 (for an order declaring that the other party to a marriage is presumed to be dead and that the marriage is dissolved):
  4. An application under section 37 (for an order dissolving a marriage).

PAYABLE UNDER RULE 5(1) OF THE DISPUTES TRIBUNALS RULES 1989

 

The following fee is payable to the Tribunal at the time of the lodging of a claim:

 
 
  • If the total amount in respect of which an order of a Tribunal is sought under the claim is less than $1,000

  • If the total amount in respect of which an order of a Tribunal is sought under the claim is $1,000 or more but less than $2,500:

  • If the total amount in respect of which an order of a Tribunal is sought under the claim is $2,500 or more but less than $5,000:

  • If the total amount in respect of which an order of a Tribunal is sought under the claim is $5,000 or more but less than $7,500:
